Terms of service

Welcome to nitro-racing.com (the "Site"), operated by Nitro Racing LLC ("Nitro Racing," "we," "us," "our"). By using the Site or purchasing our products, you agree to these Terms of Service ("Terms"). Please read them carefully.
1. Our Services
Nitro Racing sells digital iRacing setups and related content:
- Weekly Setups — one-time digital purchases of setup files for a specific series and race.
- Series Subscriptions — recurring digital access to setups for a series (Cup, O'Reilly, or Truck), billed monthly, quarterly, or annually.
We also maintain a Discord community, linked from the Site, which is governed by Discord's own terms — not these Terms.
2. Accounts
You're responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at russ@nitro-racing.com if you suspect unauthorized use.
3. Discord Login & Performance Center
You may log in to the Site or the Performance Center using your Discord account. By doing so, you authorize us to receive and store your Discord ID (and username/avatar) to identify your account and match it to your subscription. See our Privacy Policy for exactly what Discord data we receive and why.
The Performance Center is available only to Nitro Racing team members and active subscribers. It displays iRacing statistics (license, iRating/safety rating, race results, and similar performance data — the same information visible through iRacing's own member interface) matched to your account, which we retrieve using our own access to iRacing's official Data API. We don't access your iRacing password or other account details, and this data is used only to display it back to you and your team inside the Performance Center.
4. Purchases & Subscriptions
- Weekly Setups are one-time purchases, delivered digitally on completion of payment.
- Series Subscriptions automatically renew each billing period (monthly, quarterly, or annual, per the plan you select) until you cancel. See our Refund Policy for full billing, cancellation, and price-change terms — it's part of these Terms by reference.
- All prices are in USD unless your checkout shows otherwise via currency conversion.
5. License to Use Setups
Setup files are licensed to you for your personal use only. You may not resell, redistribute, share, or publish setup files to any third party, including teammates who haven't separately purchased access. We reserve the right to suspend or terminate accounts found redistributing purchased content.
6. Acceptable Use
You agree not to use the Site in any way that's unlawful, that could damage or overburden the Site, or that attempts to access data or systems you're not authorized to access.
7. Third-Party Services
The Site is powered by Shopify and uses a third-party payment processor to handle transactions. Your purchase may also involve Shopify's own terms and privacy practices — see our Privacy Policy for details. Links to Discord, iRacing, or other third-party sites/services are provided for convenience or feature functionality; we don't control and aren't responsible for third-party content, and your use of Discord or iRacing is separately governed by their own terms.
8. Disclaimer of Warranties
The Site and our products are provided "as is." We don't guarantee that setups will improve your race results, that the Site will be uninterrupted or error-free, or that content is free of defects — beyond our obligations under the Refund Policy and any statutory consumer guarantees that apply in your jurisdiction (see below).
9. Limitation of Liability
To the maximum extent permitted by law, Nitro Racing isn't liable for indirect, incidental, or consequential damages arising from your use of the Site or our products. Nothing here excludes liability that can't lawfully be excluded, including non-excludable consumer guarantees under the Australian Consumer Law or equivalent consumer-protection law in your jurisdiction.
10. Termination
We may suspend or terminate your access to the Site or your subscription if you violate these Terms, most likely for unauthorized redistribution of purchased content.
11. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, without prejudice to any non-excludable statutory consumer rights you have in your own country.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes take effect means you accept the updated Terms.
